Terms of Service

1. GENERAL PROVISIONS

  1. These Terms and Conditions apply to the services provided by ZDRO TECH, located at ALEJA JANA PAWŁA II 43A / 37B, 01-001 WARSAW, NIP: 5273121900, REGON: 529213539, registered in the Register of Entrepreneurs of the National Court Register under KRS number: 0001117795, registration court: DISTRICT COURT FOR THE CAPITAL CITY OF WARSAW IN WARSAW, XIII COMMERCIAL DEPARTMENT OF THE NATIONAL COURT REGISTER, with a share capital of 5000 PLN, hereinafter referred to as "ZDRO TECH".
  2. The Terms and Conditions are available on the website https://4.care/terms-of-service.
  3. Before using the Service, the User is required to familiarize themselves with the provisions of these Terms and Conditions.
  4. Details regarding the collection and processing of personal data are described in the document "Consent to Data Processing."
  5. The following regulations specifically apply to these Terms and Conditions:
    • a. The Telecommunications Act of July 16, 2004;
    • b. The Act on Providing Services by Electronic Means of July 18, 2002;
    • c. The Act on Patient Rights and the Patient's Rights Ombudsman of November 6, 2008;
    • d. The Civil Code of April 23, 1964.

3. ORGANIZER OF TELEMEDICAL SERVICES

  1. The organizer of telemedical services is Zdro Tech.
  2. The Organizer is a medical entity registered in the register of entities performing medical activities.

4. REGISTRATION ON THE PORTAL

  1. Registration on the Portal requires providing personal data in accordance with the document "Consent to Data Processing."
  2. The Patient is obliged not to disclose account access data.
  3. Each Patient may have only one account.
  4. Technical requirements: a device with Internet access, an up-to-date browser version, an active email account, and a mobile phone.

5. SERVICES - GENERAL INFORMATION

  1. Telemedical services include medical consultations.
  2. Services are provided by qualified Service Providers.
  3. Consultations may take place using communication technologies.
  4. The Organizer may record conversations in accordance with the Call Recording Policy.
  5. Telemedical services do not replace in-person medical advice in emergency situations.

6. PROVISION OF TELEMEDICAL SERVICES

  1. Telemedical services are provided based on the Patient's health condition description and the information provided by the Patient.
  2. The Patient is responsible for the accuracy of the information provided.
  3. The Organizer does not verify insurance status; medications are not reimbursed.
  4. Service provision procedure:
    • a. The Patient selects a medical consultation;
    • b. Describes their health condition;
    • c. The Service Provider reviews the submission and provides feedback.
  5. The Service Provider may request additional information or medical documentation.
  6. Services are provided within 2 working days.
  7. The Service Provider may refuse to provide the service in specific cases.
  8. The service usually lasts from 15 to 40 minutes.
  9. Services may last from 15 minutes to 8 hours; the organizer strives to complete services within 40 minutes.
  10. The Service Provider may refuse to provide the service for medical reasons.

7. PATIENT OBLIGATIONS

  1. The Patient undertakes to provide true information about their health condition.
  2. The Patient should review the correspondence and medication leaflets.
  3. The Patient should contact a doctor in case of side effects from medications.
  4. In emergencies, the Patient should call for help at 112.
  5. The Patient should inform the Service Provider about side effects of medications.

8. COMPLAINTS

  1. The Patient has the right to file complaints related to telemedical services.
  2. Complaints should be submitted via the contact form.
  3. Complaints are processed within 14 working days.

9. SERVICE PRICES AND PROMOTIONS

  1. Service prices are given in Polish zloty (PLN).
  2. The base price of a telemedical service is indicated on the Portal.
  3. The Patient is informed of the service price before making a payment.
  4. Service prices may change.

10. TERMINATION OF THE AGREEMENT

  1. The agreement is concluded when the Patient makes a payment.
  2. The Patient may request a refund for an unfinished consultation within 14 days of the agreement's conclusion.
  3. The Service Provider may also terminate the agreement, in which case funds are refunded. This may occur if the Service Provider deems they cannot assist the Patient online.

11. LIABILITY RULES

  1. The Organizer is not liable for services provided by Service Providers.
  2. Service Providers are responsible for their services.
  3. The Organizer is not liable for the provision of false information by the Patient.

12. INFORMATION POSTED ON THE PORTAL

  1. Medical information on the Portal does not constitute medical advice.
  2. The Organizer is not responsible for content posted on third-party websites.

13. INTELLECTUAL PROPERTY RIGHTS

  1. The Organizer is the owner or licensee of all intellectual property rights to the Portal.
  2. Use of content from the Portal requires the Organizer's consent.

14. CHANGES TO THE TERMS AND CONDITIONS

  1. The Organizer reserves the right to change the Terms and Conditions.
  2. The Patient will be informed of changes via the Portal or email.
